Terms and Conditions

1. Introduction & Scope

These Terms and Conditions ("Terms") govern your access to and use of Kid World Readers ("KWR", "we", "us", "our"), including our website, our digital literacy programmes, and our VIP Tutoring services, as purchased by you, the parent or legal guardian ("you", "the Customer") on behalf of a child in your care.

By purchasing or accessing any KWR product or service, you agree to be bound by these Terms. If you do not agree, please do not purchase or access our products or services.

Nothing in these Terms limits or excludes any right or remedy you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 (or, where applicable to overseas customers, equivalent consumer protection legislation such as the Australian Consumer Law). Where any clause in these Terms would otherwise conflict with those rights, your statutory rights prevail.

These Terms are governed by the laws of New Zealand. If you are purchasing from outside New Zealand, this does not remove any non-excludable consumer protections you may hold under the law of your own country.

1.1 Our Commitment to Good Faith and Relationship (Whanaungatanga)

At Kid World Readers, we believe education is built on connection, mutual respect, and trust. Our business operates in the spirit of good faith — we promise to treat every family with fairness, flexibility, and heart, and we ask that our families engage with us in that same cooperative, respectful spirit. While we have clear policies to keep our small school running smoothly, we always aim to communicate openly and resolve scheduling, billing, or learning challenges through positive, collaborative discussion.

2. Definitions

  • "Digital Products" means the Monthly Membership, Annual Membership, and The Reading Roadmap, each as described on the KWR website.
  • "VIP Tutoring" means the Kickstart, VIP Support, or VIP Intensive tutoring packages delivered in three-month Cohorts.
  • "Cohort" means a fixed three-month VIP Tutoring group/schedule with a stated start date and end date.
  • "Parent Membership" means the parent education component included with the Annual Membership and The Reading Roadmap.
  • "Platform" means LearnWorlds, the third-party platform through which our Digital Products are delivered.

3. Eligibility & Accounts

KWR's programmes are designed for children aged approximately 4–8 years. Accounts are held by the parent or legal guardian; children do not hold their own independent account.

You agree to provide accurate, current information when creating an account and purchasing any product or service. One account is provided per purchasing family and is not to be shared across other families or children outside your household.

We may suspend or terminate an account where these Terms have been breached, including in connection with unauthorised sharing of login details or course materials (see Section 9).

4. Digital Programme Access (Monthly & Annual Memberships)

4.1 What's included

The specific inclusions of the Monthly Membership and Annual Membership are as set out on our current Pricing page at the time of purchase, which forms part of these Terms by reference. In summary:

  • Monthly Membership: kids' video lessons only.
  • Annual Membership: full programme, The Reading Roadmap, Parent Membership, extended assessment, a 30-minute onboarding call, and eligibility to book VIP Tutoring, with 13 months of access.

4.2 Access

Content is delivered progressively ("drip-fed") via the Platform. You are responsible for ensuring you have a compatible device and internet connection. Course videos and materials may not be downloaded, copied, or redistributed (see Section 9).

4.3 Billing

Monthly Membership is billed on a recurring monthly basis in USD; NZD/AUD amounts shown are indicative only and may vary with exchange rates. Annual Membership is billed as a single annual charge providing 13 months of access.

4.4 Cancellation

Monthly Membership may be cancelled at any time, effective at the end of the current paid billing period. No partial-month refund is provided for the remainder of a period already paid for, in which access remains available.

Annual Membership may be cancelled subject to the change-of-mind refund policy in Section 6 below. Outside of that window, the Annual Membership is a fixed 13-month term and is not refundable for unused months, except where required under the Consumer Guarantees Act (for example, where KWR fails to deliver the programme as described).

4.5 Free Trial

Our free trial requires no credit card and does not automatically convert to a paid plan. Should this ever change, we will state clearly, before you start a trial, what will happen at the end of it and require your clear consent before any payment is taken.

5. The Reading Roadmap (Standalone Purchase)

The Reading Roadmap is a one-time purchase providing lifetime access to parent education modules, toolkit, and community, and does not include kids' video lessons or the Lesson Sets Handbook.

Community access is provided for support and connection between parents and is not a substitute for professional educational, medical, or psychological advice. We reserve the right to moderate community spaces and remove content or participants that breach standards of respectful conduct.

6. Refunds & Change of Mind

6.1 Digital Products (Monthly Membership, Annual Membership, The Reading Roadmap)

You may request a full refund, less a 5% payment processing fee, within 14 days of the date of purchase, provided you have not yet accessed the digital content (including logging into any course, lesson, or module).

Once you have accessed the digital content, you are no longer entitled to a change-of-mind refund, regardless of how much of the 14-day period remains. This does not affect any right you may have to a remedy under the Consumer Guarantees Act 1993 if the product is faulty, not fit for purpose, or materially different from its description.

This 14-day change-of-mind period applies only to Digital Products. It does not apply to VIP Tutoring, which is governed exclusively by Section 7 below.

6.2 How to request a refund

Refund requests can be made by contacting us directly at [insert contact email]. We will respond within [insert number] business days.

6.3 How refunds are processed

Where a refund is approved (whether for a Digital Product or a VIP Tutoring package under Section 7), it is issued directly back to your original payment method via our secure payment gateway, Stripe. Please allow 5–10 business days for the refund to clear and appear in your account, depending on your bank or card provider's own processing times.

7. VIP Tutoring — Packages & Cohorts

7.1 Prerequisite

An active Annual Membership is required to book any VIP Tutoring package. If your Annual Membership lapses during an active Cohort, we will contact you to discuss options before any tutoring access is affected.

7.2 Cohort structure

VIP Tutoring is delivered in three-month Cohorts. The VIP Intensive package comprises 10 sessions, delivered approximately weekly. Cohort start and end dates are fixed and are stated on your invoice. Cohorts are booked and paid for as a complete package in advance of the stated Cohort dates.

KWR reserves the right to manage waitlists for Cohorts at its sole discretion, including the order in which places are offered.

7.3 Cancellation before or after Cohort start

The administration fee reflects payment processing costs, administrative time in adjusting the Cohort roster and waitlist, and the Cohort place held on your behalf. This is separate from, and does not affect, any right to a refund where KWR itself fails to deliver the service (see Section 7.6).

7.3a Withdrawal after the Cohort has started

Once a Cohort has started, a parent wishing to withdraw their child must provide no less than three (3) weeks' written notice of their intention to do so. This notice period gives KWR the opportunity to fill the vacated place. During this notice period, the parent remains liable for payment of the applicable session fees, regardless of whether those sessions are attended.

A credit toward a future Cohort may still be offered at KWR's sole discretion in cases of genuine extenuating circumstances (e.g. serious illness). This is not a standard entitlement and is assessed case by case.

Cohort length cannot be shortened at the Customer's request; a Cohort runs for its full stated three-month term.

7.4 Rescheduling individual sessions

If you need to move an individual session, please provide at least 24 hours' notice. Up to two (2) sessions per Cohort may be rescheduled in this way, subject to tutor availability. Any further rescheduling requests beyond this limit, and any session for which less than 24 hours' notice is given, will be forfeited with no refund and no make-up session.

Sessions missed without any notice (no-shows) are forfeited outright — no reschedule and no refund applies.

7.5 Your responsibilities

It is your responsibility to ensure your child attends each scheduled session at the correct date and time. All online tutoring sessions must be supervised by an adult.

Payment for VIP Tutoring is due on the date specified on your invoice.

7.6 If KWR is unable to deliver a session

If we are unable to deliver a scheduled session, we will offer a replacement session at no additional cost. Where rescheduling is not possible, or where there is a serious or repeated failure to deliver the service, a refund may apply in respect of the undelivered sessions, in line with your rights under the Consumer Guarantees Act 1993.

7.7 Recording

By booking VIP Tutoring (or any live session), you consent to that session being recorded for quality, training, and continuity purposes. Recordings are handled in accordance with our Privacy Policy.

8. Parent/Guardian Responsibilities

  • Supervising your child during all online lessons and tutoring sessions.
  • Providing accurate information about your child's needs, including any diagnosed learning needs relevant to tutoring.
  • Ensuring login details are kept private and not shared outside your immediate household.
  • Using course materials, videos, and resources for personal, non-commercial, family use only.

9. Intellectual Property

All Lesson Sets, videos, The Reading Roadmap materials, the Lesson Sets Handbook, and all other KWR content remain the intellectual property of Kid World Readers. A licence is granted to the purchasing family for personal, home use only. This licence is non-transferable and may not be copied, redistributed, resold, or shared outside your household without our prior written permission. Login credentials are for your personal use only and must not be shared.

10. Privacy & Communications

Personal information is handled in accordance with our Privacy Policy, available at [insert link]. We use third-party service providers, including LearnWorlds (platform hosting), Flodesk (email communications), Zapier (integration between systems), and Stripe (payment processing), to operate our services.

Marketing communications are sent in accordance with the Unsolicited Electronic Messages Act 2007. You may unsubscribe from marketing emails at any time using the link provided in each email.

11. Platform & Availability

Our Digital Products are delivered via LearnWorlds, a third-party platform. While we take reasonable steps to ensure availability, we are not responsible for outages or issues caused by the Platform or other third-party services outside our direct control. We may update or improve programme content from time to time without materially reducing its overall value to you.

12. Limitation of Liability

Our programmes and tutoring are designed to support your child's literacy development and do not replace a professional educational, medical, or psychological assessment (including for dyslexia or other learning differences). Where you have concerns about your child's development, we encourage you to seek advice from a qualified professional.

We do not guarantee specific results or outcomes from any KWR programme or VIP Tutoring package. Every child is different, home environments and levels of engagement with the programme vary, and children learn to read at different rates. While our programmes are built on evidence-based literacy instruction, the pace and extent of any individual child's progress cannot be promised or assured.

To the maximum extent permitted by law, our liability to you is limited to the amount you paid for the relevant product or service. Nothing in this Section limits or excludes any right you have under the Consumer Guarantees Act 1993 that cannot lawfully be excluded.

13. Complaints & Dispute Resolution

If you have a concern, please contact us directly at [kate@kidworldreaders.com] in the first instance. We aim to respond within [insert number] business days.

If a dispute cannot be resolved directly and relates to your rights under the Consumer Guarantees Act 1993, you may take your claim to the New Zealand Disputes Tribunal, which hears claims up to $60,000 without the need for a lawyer.

14. International Customers

Prices are transacted in USD. NZD and AUD amounts shown are indicative estimates only and may vary with exchange rates at the time of payment.

These Terms are governed by New Zealand law. If you are purchasing from Australia or another country, this does not remove any non-excludable consumer guarantee you hold under the law of your own country (for example, the Australian Consumer Law), to the extent it applies.

15. Changes to These Terms

We may update these Terms at any time, and updates take effect immediately once published on our website. Changes apply prospectively and do not remove any right you had already accrued under the version of these Terms in place at the time of your purchase.

16. Termination

We may suspend or terminate your account for non-payment, misuse of the Platform, or breach of these Terms, including unauthorised sharing or redistribution of course materials or login details. Where an account is terminated for cause, no refund is owed for the period of access already provided.

17. General

17.1 Acceptable Communication

If we provide any community, comment, or messaging features, you agree not to post content that is abusive, defamatory, obscene, threatening, or otherwise unlawful, and not to use these features to send unsolicited advertising or spam. We may remove content or restrict access to these features at our discretion where this Section is breached.

17.2 No Waiver

If we do not enforce any part of these Terms at any time, this is not a waiver of our right to do so later. No waiver of any breach of these Terms will be considered a waiver of any subsequent breach.

17.3 Third Party Rights

These Terms are between you and Kid World Readers only. No other person has any right to enforce any of these Terms, whether under any third party rights legislation or otherwise.

17.4 Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply in full.

17.5 Mutual Respect and Good Faith Engagement

Kid World Readers is a relationally driven educational service. We prioritise a supportive, positive environment for our tutors, students, and parents, and we ask that all communications, requests, and requests for changes, cancellations, or refunds be made respectfully and in good faith. We commit to responding in the same way.

This clause does not limit or affect your right to raise a genuine complaint, request a refund, or assert your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986, however firmly. It is intended to address conduct that is abusive, threatening, or harassing toward our team, not the assertive exercise of your legal rights. Where such conduct occurs, we reserve the right to decline further service.
